the frame rate could be a little smoother, but I think you'll pass. you should try putting a little more effort into it; work at least 3 to 4 hours onto it. I'm only giving you a 5 because this is your first flash, but if it wasn't I'd say:
"GODDAMNIT YOU SUCK MONKEY FUCK!" But I'm not, because its your first submission. You'll hopefully get better.

That song is "Dead Cell" from Metal Gear Solid 3: Snake Eater. The other two songs are from Psychonauts; "The Matador" and "The Milkman Conspiracy," respectively.
